AI Services Terms of Use

1. Usage

1. These terms apply to the conversational experience on, and Client and its Users use of any artificial intelligence ("AI") powered generative experiences on the Fireblocks platform (“AI Services”), including experiences such as the Fireblocks Genie chatbot service.

2. The AI Services are powered by technology from third-party providers, including Anthropic Sonnet and Snowflake Cortex, based on generative AI. 

3. If the Client (and/or its Users) elect to use the AI Services, these terms apply to that use, and the Client (and relevant Users) agree to comply with such terms. 

4. Client may cease use of the AI Services at any time, by simply choosing not to utilise or engage with the AI Services.

5. Client and its Users shall not use the AI Services in any way that:

   1. that violates or facilitates the violation of applicable law, compromises privacy or identity rights, or is engaging in fraudulent, abusive, or predatory practices;

   2. that is intended to harm others (other than normal competition with third parties) or impairs their authorized use of the AI Services, or compromises critical infrastructure, computer or network systems;

   3. that violates Fireblocks’s intellectual property rights or otherwise competes with Fireblocks, and any use will be in compliance with the relevant usage policies of the applicable third-party providers at:

6. Client recognize that AI, particularly generative AI, is a novel and evolving field. There may be unknown risks, and the technology’s safeguards may not be comprehensive. Client assumes full responsibility for any risks arising from its, and its Users, use of the AI Services, including but not limited to accepting that Outputs may not always be accurate or appropriate. Client is responsible for verifying the suitability and correctness of Content for its intended applications.

7. Client must not use AI Services without first determining if its use of such feature is effective and safe, and appropriate for it.  The AI Services and/or any components thereof are not intended to be used for and Client shall not use the AI Services for: (i) prohibited practices under the European Union Artificial Intelligence Act (the “EU AI Act”) (ii) any use that would result in the AI Services being declared a high-risk AI system or that otherwise qualifies as “high-risk” under the EU AI Act or (iii) any use that is sensitive, critical, unsafe, high-risk, or hazardous (including any use that could result in death or serious bodily injury, catastrophic damage, warfare, or the operation of critical infrastructure). Client is responsible for any decisions, actions, and/or inactions arising from its use of AI Services, including ensuring compliance with applicable laws, regulations, and other legal requirements.

2. Content

   1. The AI Services are designed to assist Users by answering questions, providing information, and supporting interaction with Fireblocks products and services, as well as other related use cases.

   2. The AI Services allow Users to submit various forms of input—including text, natural language statements, prompts, SQL requests, or other queries (“Input”). Based on this Input, the AI Services generate responses such as text, images, or other formats (“Output”). Collectively, Input and Output are referred to as “Content.”

   3. Client may not misrepresent the origin of any response or result from the AI Services after processing an Input by claiming or implying such Output was created by a human or representing the Output as an original work. 

   4. Client may not remove any markings that are automatically applied to an Output to indicate that such Output was artificially generated. Client will promptly stop using, displaying, or distributing any Output if it receives a claim that such Output violates a third party’s intellectual property rights, or notice that such a claim has been made. Client shall not use or communicate to third parties any Output in breach of any rules relating to “deepfake” content that are imposed on Client by applicable law. 

   5. Content is and remains the property of the Client, with the understanding that the Client bears all responsibility for its legality, accuracy, and appropriateness. Fireblocks claims no ownership over such Content, but also disclaims any warranties regarding its use or application.

   6. It is the sole responsibility of the Users to review, modify, and validate AI-generated content before its utilization or publication.

   7. Client and its Users are solely responsible for how they use the Output. Including reviewing, verifying, fact-checking, validating, modifying, citing, revising, and classifying Content. The AI Services may lead to responses of varying degrees of accuracy that may not reflect the intent or content of the source material. 

   8. In addition to generating informational Outputs, the AI Services may, where expressly authorized by the User, execute certain actions on the User’s behalf (for example, activating APIs or initiating other permitted functions). Any such execution is strictly subject to the permissions granted by the User.

3. Data

   1. Data submitted by the Client and its Users through the AI Services will be processed in accordance with the DPA available at: https://www.fireblocks.com/data-processing-agreement/ and the Privacy Policy, available at https://www.fireblocks.com/privacy-policy/, as amended by Fireblocks from time-to-time.

4. Warranty and acknowledgement

   1. WITHOUT LIMITATION, THE AI SERVICES AND ANY OUTPUT IS PROVIDED “AS-IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.  IN ADDITION, FIREBLOCKS DISCLAIMS ANY AND ALL RESPONSIBILITY WITH REGARDS TO THE CURRENCY AND ACCURACY OF OUTPUT PROVIDED THROUGH THE AI SERVICES, AND WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE (DIRECT OR INDIRECT) ARISING FROM USE OF THE AI SERVICES OR OUTPUT.

   2. Client acknowledges and accepts that it:

      1. is its responsibility to ensure that any Content generated by the AI Services is used in a correct, appropriate and responsible manner;

      2. will not rely on Outputs as a sole source of truth or factual information;

      3. will not rely on Outputs as a replacement or substitute for professional advice; 

      4. will not disable, evade, disrupt, or interfere with any content filters or safety systems that are part of the AI Services; and

      5. shall be fully liable and responsible for any use of Content from the AI Services

   3. Client will report any violations of these terms, or any issues with any of the AI Services, to Fireblocks’ legal department at legal@fireblocks.com
